Rulemaking for Establishing Fees For Increasing Licensed Capacity in Child Care Facilities

The Department has amended the Child Care Facilities rules through exempt rulemaking under authority given by Laws 2009, Third Special Session, Ch. 10, § 37 and Ch. 7, § 28 and Laws 2010, Chapter 248, § 5. The rulemaking establishes a fee for a facility increasing its licensed capacity that is equal to the pro-rated difference between the fee for the current capacity and the fee for the proposed capacity.

The Department drafted a Notice of Exempt Rulemaking, solicited informal public comment about the draft exempt rulemaking, and reviewed the comments received.

The Department filed the Notice of Exempt Rulemaking with the Office of the Secretary of State on November 12, 2010, with the effective date of the rules on December 1, 2010. A link to the Notice of Exempt Rulemaking is available below.
