The Department has amended the rules in Arizona Administrative Code (A.A.C.) Title 9, Chapter 8, Article 1 for Food and Drink to incorporate the recent statutory changes made in Laws 2006, Chapter 272, § 1, Laws 2008, Chapter 149, §1, and Laws 2011, Chapter 84, § 1. These statutory changes require the Department to add specific types of foods or foods prepared for specific occasions to the list of food or drink to be exempted from the requirements in 9 A.A.C. 8, Article 1.
The purpose of this page is to provide information about the Food and Drink rulemaking. The Department submitted a Notice of Proposed Rulemaking to the Office of the Secretary of State, which was published in the Arizona Administrative Register on August 19, 2011, and held an Oral Proceeding for the rulemaking on September 23, 2011. The Department received several comments on the proposed rules. These comments were considered in developing the Notice of Final Rulemaking (page 2608), which was approved by the Governor's Regulatory Review Council (GRRC) at the December 6, 2011 GRRC meeting. A summary of the comments and the Department's responses are provided below. The rules are effective on February 4, 2012.
