Midwifery Rulemaking

The Arizona Department of Health Services (Department) licenses and regulates midwives according to A.R.S. Title 36, Chapter 6, Article 7 (A.R.S. §§ 36-751 through 36-760). These statutes are implemented by Title 9, Chapter 16, Article 1 of the Arizona Administrative Code (R9-16-101 through R9-16-111).

The Department is revising the midwifery rules through two consecutive rulemaking projects. In the first midwifery rulemaking project, the Department will revise the rules related to the midwife license, R9-16-101 through R9-16-105.01. After the midwife license rules have been revised, the second midwifery rulemaking project will revise the rules that include scope of practice and enforcement, R9-16-106 through R9-16-111.

Interested persons will have an opportunity to participate in the rulemaking process with their discussion and comments. This web page will provide information about the midwifery rulemaking, including timelines and draft rules. The Department suggests that you visit this site often to see the latest updates.
