CB01: What is an operating dispensary?

Arizona Department of Health Services (ADHS) considers a dispensary to be operational after ADHS has issued an Approval to Operate Certificate and when the dispensary is open and dispensing medical marijuana.

CB02: What does it mean to live within 25 miles of an operating dispensary?

A qualifying patient lives within 25 miles of an operating dispensary if the residential address is located within a circle that extends for 25 miles in all directions from the operating dispensary (i.e., "as the crow flies").

CB03: What happens if I apply for a qualifying patient card and live within 25 miles of an operating dispensary?

The qualifying patient's residential address will be checked during the application process. If the qualifying patient requests to cultivate, the applicant will be notified that proceeding through the application may result in a denial and the application fee will be lost. The qualifying patient is also provided an opportunity to change the selection to not cultivate and proceed through the application.

CB04: What happens if I apply for a qualifying patient card and live outside of 25 miles of an operating dispensary?

The qualifying patient may choose whether he or she would like to cultivate or whether the qualifying patient's designated caregiver (if applicable) should cultivate on the qualifying patient's behalf.

CB05: What happens if I am issued a card and a dispensary becomes operational after? Will I receive a new card?

No, unless you change your address or replace, add, or remove a designated caregiver, you will not receive a new card. Your cultivation status can be retained until you renew your card.

CB06: What happens if I move?

When a qualifying patient submits an application to change his or her address, the residential address will be checked. If the qualifying patient lives within 25 miles of an operating dispensary, cultivation will not be approved.

CB07: What happens if I replace, add or remove a caregiver?

When a qualifying patient submits an application to change his or her address, the residential address will be checked. If the qualifying patient lives within 25 miles of an operating dispensary, cultivation will not be approved.

CB08: What happens if I use the change application to change my cultivation status?

When a qualifying patient submits an application to change his or her cultivation status, the patient’s residential address will be checked. If the qualifying patient lives within 25 miles of an operating dispensary, cultivation will not be approved.

CB09: What happens if I change only my name?

When a qualifying patient submits an application to change his or her name, the residential address will not be checked.

CB10: What happens if I change only my gender?

When a qualifying patient submits an application to change his or her gender, the residential address will not be checked.

CB11: Can I designate a caregiver after dispensaries are open?

Yes, a qualifying patient may always choose to designate a caregiver. However, if at the time a qualifying patient application is submitted and the qualifying patient's residential address is within 25 miles of an operating dispensary, neither the qualifying patient nor the designated caregiver will be allowed to cultivate.

CB12: What happens if I am a designated caregiver and the qualifying patient I am associated with is no longer authorized to cultivate?

The designated caregiver will receive a new card stating that the designated caregiver is not authorized to cultivate marijuana for that patient.

CB13: Where can I find a list of operating dispensaries?

When a qualifying patient application is approved, the list of operating dispensaries will be included as an attachment in the approval email that is automatically generated from the system. ADHS cannot provide the list of operating dispensaries by any other means (A.R.S. §36-2810(A)(2)).

CB14: If I am authorized to cultivate, can I still purchase medical marijuana from a non-profit medical marijuana dispensary?

Yes.

CB15: Can I use a mailing address (i.e., P.O. Box) on my application?

Unless the qualifying patient is homeless, a qualifying patient application must include a residential address. The application may also include a mailing address. However, the residential address will be checked within the system to determine its location from an operating dispensary.

CB16: What is considered a "good" (able to be located) address?

In order to locate your residential address, you should ensure you include a:

  • Street Number
  • Street Direction (if exists) (i.e., E, W, S, N)
  • Proper Street Suffix (i.e., St., Blvd., Ave.)
  • City
  • Postal Code
