Following a series of hearings throughout the state and after reviewing more than 600 public comments, the Arizona Department of Health Services today announced final rules for the Smoke-Free Arizona Act.
The Smoke-Free Arizona Act prohibits smoking in most indoor establishments. Passed by voters last November, it goes into effect on May 1, 2007.
The finalized rules released today state that:
Smoking is prohibited within 20 feet of any business entrance.
Over 300 comments addressed this proposed foot rule. The majority of these comments asked that the foot requirement be greater than 15 feet. A review of current research determined that 20 feet is a safe distance to protect people from smoke.
Patios are exempt, as long as smoke does not drift into indoor areas.
When people other than bona-fide guests are present in fraternal or veterans clubs, smoking is not permitted.
A bona-fide guest is one who has received a specific and personal invitation to attend the club, event, etc. This definition of “open to the public” is equivalent to the liquor licensing rules.
