Court Ordered Program Approvals Rulemaking (Exempt)

As part of implementing Laws 2011, Chapter 96, the Department conducted rulemaking to remove the licensing of health care institutions that provide behavioral health services from Arizona Administrative Code (A.A.C.) Title 9, Chapter 20. The rules in 9 A.A.C. 20 also had to be amended in order to address other types of behavioral health service agencies that provide court ordered services, such as facilities that provide DUI services, misdemeanor domestic violence offender treatment, or adult therapeutic foster care.

DUI Services

A.R.S. § 36-2006 requires the Department to adopt "rules establishing the standards for approval of alcohol and other drug screening, education and treatment facilities" and the standards for referrals to these facilities. The previous rules for facilities providing DUI services were in 9 A.A.C. 20, Article 9. The new rules are located to Article 1.

Misdemeanor Domestic Violence Offender Treatment Services

A.R.S. § 13-3601.01 specifies that a judge "shall order a person who is convicted of a misdemeanor domestic violence offence to complete a domestic violence offender treatment program that is provided by a facility approved" by the Department or probation department. The previous rules for these facilities were in 9 A.A.C. 20, Article 11. The new rules are in Article 2.

Adult Therapeutic Foster Homes (Behavioral Health Supportive Homes)

A.R.S. § 36-502 requires the Department to adopt rules that include standards for agencies providing mental health services to individuals under A.R.S. Title 36, Chapter 5. The previous rules for adult therapeutic foster homes were in 9 A.A.C. 20, Article 15. The Department had originally planned to adopt rules for adult therapeutic foster homes in Article 3. However, upon learning more about the services provided in these facilities, the Department instead adopted rules for these facilities in 9 A.A.C. 10, Article 16, as behavioral health supportive homes providing adult behavioral health therapeutic supportive services, as part of the Health Care Institution (HCI) Licensing rulemaking.
